The Fiqh of Medicine - Responses in Islamic Jurisprudence to developments in Medical Science

 Paperback - 368 pages

by Dr Ahmed Abdel Aziz Yacoub

Medical science has made remarkable developments over the last half century. This book examines in depth a wide range of legal and moral aspects of responsibility and medical liability within the Islamic context. Particular reference is made to euthanasia, prevention and termination of pregnancy, reproduction and cloning, and transplantation. What are the bases in Fiqh that guide medical practitioners in their daily work as they avail themselves of developments in medical science? This book may well prove to be a standard reference for the medical profession and fuqaha (jurists).

For more than a decade the author of this work, Dr. Ahmed Abdel Aziz Yacoub, worked very hard in two different fields. First, as a specialist heart surgeon in the course of which he directly encountered problems associated with the development of medical science. Second, he embarked on the study of law as an undergraduate student at Cairo University (Khartoum Branch), and as a postgraduate student at the University of Khartoum at which he earned Bachelor's and Master's degrees.  He then proceeded to study for a doctoral degree at the University of London, where his research and analysis of vast material on medical science and law earned him a PhD in jurisprudence, in July 2000. This book derives from that PhD thesis.

Al-Ahkam as-Sultaniyyah  -  The Laws of Islamic Governance

 Paperback - 381 pages

Al-Ahkam as-Sultaniyyah

Abul Hasan al-Mawardi
Translated by Dr. Asadullah Yate

Al-Ahkam as-Sultaniyyah is both the single most comprehensive account of the workings of Islamic governance and equally a highly influential theoretical outline of the nature of that governance.

Woven throughout it are accounts of the first community of Islam and the judgements of the early scholars of the
salaf which are the books lifeblood and its light.

Abul Hasan al-Mawardi (d.450 AH) was a practising Qadi [judge] whose excellent judgement earned the soubriquet ' The Most Judicious of Qadis.' Given that the role of the Qadi far exceeds that of 'judge', the author was well placed to describe the workings of power from within. Along with that, his excellence as a scholar allowed him to produce a work which is one of the undoubted classics of Islam.

Dr. Asadullah Yate gained his PhD from Cambridge with his dissertation on Ibn Rushd as Jurist. He has succeeded admirably in translating this work accurately and in making it entirely readable.

Body of Text - The Emergence of the Sunni Law of Ritual Purity
Paperback - 275 pages                                                                   by Marion Holmes Katz

Summary : Reconstructs the formative debates concerning ritual purity in Islamic law and practice. Ritual purity is one of the least understood aspects of Islamic law and practice, yet it enjoys a prominent place in traditional legal texts and permeates the daily life of ordinary believers. Body of Text examines the emergence and crystallisation of the law of ritual purity, using early sources to reconstruct the formative debates among Muslim scholars. The lively interaction among legal theorising, caliphal politics, and popular practice illustrates the formation of the law, because as scholars strove for synthesis, they advanced competing understandings of the underlying structure and meaning of ritual purity. The author Katz demonstrates that no single theory can adequately interpret the diversity of opinion within the tradition.

“…recommend[ed] … for those who are looking for a path into the sources of and the debates about formative Islam and law.” Journal of the American Oriental Society

“For too long Islamic law has been seen by academics as a body of esoteric lore discernible only to the initiated. Katz masterfully positions a detailed and technical subject—early Islamic ritual law—within the broader context of comparative religions. This book will be the starting point for any future work on the subject.” Paul M. Cobb, University of Notre Dame, author of White Banners: Contention in 'Abbasid Syria, 750–880

“Katz breaks new ground in the field of Islamic law. This is the first book to thoroughly examine the classical Islamic-law works as well as the works of Western anthropologists on matters of ritual purity.” Farhat J. Ziadeh, author of Property Law in the Arab World

The Four Imams - Their Lives, Works and their Schools of Thought

Hardback - 530 pages   by Muhammad Abu Zahra                            Translated by Aisha Bewley

This book is a compilation of four books which deal with the lives and works of the four Imams who founded the four great canonical schools of thought of Islamic fiqh - Imam Hanifa, Imam Malik, Imam Shafi'i and Imam Hanbal (May Allah be pleased with them all). The book was originally written in Arabic by the great Egyptian scholar and theologian Muhammad Abu Zahra and is presented in English for the first time.

In this book, there is a comprehensive, in depth analysis of the four Sunni madhabs and their founders, giving details of their biography and the methods they used in reaching their legal conclusions. This is particularly important important in the world today when many thousands of Muslims find themselves in a situation where there is not enough knowledge and therefore, no traditional allegiance to a particular madhab. As a result of this ignorance, there is also a great deal of futile disagreements amongst the Muslims. This work therefore has been long overdue in the English language and will be a milestone in bridging the gap amongst the Muslims and uniting them. It makes a stimulating and enriching read for all who are interested in deepening their knowledge of Islam.

The Translator : Aisha Abdurrahman at-Tarjumana Bewley is one today’s most prolific translators of classical Arabic work into English. ---- Death is not the absolute end. It is just the discontinuation of unity between the body and soul. It is a change from one state to another and a transition from this present life to that of the hereafter.

"Allah takes souls at the time of their death and [the souls] of those that do not die during their sleep. He retains those souls for which He has ordained death, whereas He releases the rest for an appointed term" [Qur'an 39:42]

Imam Abu Abdullah Muhammad ibn Abu Bakr al-Ansari al-Qurtubi was born in Cordoba, Spain, at the summlt of Its great  period of Islamic civilisation. He was an eminent Maliki scholar  who specialised in fiqh and Hadith. The breadth and depth of his scholarship are evident in his writings. The most famous of then is his twenty-volume tasfir al Jami' li-ahkam al-Qar'an, The first three volumes have been translated into English.

Imam al-Qurtubi May Allah be pleased with him, was a man of great modesty who disdained worldly honours and throughout his life wore the simple gown and cap of the ordinary Muslim. He traveled from Spain to the East and settled in Munya Abi'l-Khusavb. in Upper Egypt. where he died in 671H/ 1273

'Every soul shall have a taste of death: And only on the Day of Judgment shall you be paid your full recompense. Only he who is saved far from the Fire and admitted to the Garden will have attained the object (of Life): For the life of this world is but goods and chattels of deception'  [Qur'an 3:185]

Circumcision in Islam      by Abu Bakr Abdu'r-Razzaq

Paperback - iv +113 pages                                                             Translated by Aisha Bewley

Circumcision is a universal practice which is greatly influenced by cultural and religious traditions, especially of the Muslims and Jews. It is the most frequent operation on males not only in Islamic countries, but also other parts of the world. For example, in the United States of America more than one million male infants are circumcised each year. The performance of circumcision is one of the rules of cleanliness in Islam. It is reported by Abu Hurairah MayAllah be pleased with him that the Beloved Prophet Muhammad May Allah bless him and grant him peace mentioned:

Five are the acts quite akin to
fitra: circumcision, shaving the pubes, cutting the nails, plucking the hair under the armpits and clipping (or shaving) the moustache (Recorded in “Sahih Muslim”, “Sahih Bukhari”, “Musnad Ahmad” and “Sunnah At-Tirmidhi”). The word fitra in relation to cleanliness can refer to the Sunnah (tradition) of the Prophet May Allah bless him and grant him peace with regard to this matter, and fitra also “implies an inner sense of cleanliness in man which is proof of his moral convictions and mental health”.

Circumcision means removal of the foreskin of the penis. The Islamic scholar Al-Mawardi said, “The ideal method is to remove the skin completely from the beginning of the glens, and the minimum condition is that nothing is left to cover the end of the glens”. The Beloved Prophet Muhammad
May Allah bless him and grant him peace recommended performing circumcision at an early age. Al-Mawardi stated that the chosen time is the 7th day after birth, but it can be carried out up to 40 days after birth or thereafter until the age of 7 years, depending upon the health of the infant or child at the time.

This is the first comprehensive book on the topic. It clarifies the meaning of circumcision, its history, the opinion of science, medicine and religion regarding it, its effects from a psychological, social and moral perspective.

Marriage on Trial : A Study of Islamic Family Law

 Paperback - 276 pages                                                         by Ziba Mir-Hosseini

Debates over family law are a sensitive subject in the Muslim world, revealing something of the struggle between forces of traditionalism and modernism. The highly disparate tendencies within Islamic "fundamentalism" share a desire to re-institute Shar'ia law, regarded as the last bastion of the Islamic ideal of social relations.

This book probes the theory and practice of Islamic family law in the contemporary Muslim world, focusing on the dynamics of marriage and the consequences of its breakdown, and the ways in which litigants manipulate the law to resolve marital and child custody disputes.

''One of the best, most original and liveliest bookson the subject ... goes beyond the classical textbooks of fiqh, and asks how law is actually interpreted, administered and used in Muslim societies.'' --- Albert Housrani

JA AL HAQ : The Obliteration of Falsehood (NEW : 2nd Edition)''Back in Stock''

Hardback - 600 pages     [ ENGLISH ]       by Mufti Ahmad Yaar Khan Na'imi Ashrafi alayhir rahman

Translated into English:  by Mawlana Omar Dawood Qadiri Mu'ini

ABOUT THE BOOK: The Obliteration of Falsehood is an English translation of Hadrat Mufti Ahmad Yaar Khan Ashrafi's Allah be pleased with him celebrated Ja 'al-Haqq, one of the most complete, recognised and irrefutable works on proving the practices and beliefs of the Muslim Ummah for the questions raised in the modern era.

In an age wherein an increasing number of individuals believe they have the right and power to deduce the fundamentals of Islam based on a superficial understanding of the Qur'an and Hadith, Ja 'al-Haqq stands tall as a testament to the unsurpassed examinations and watertight judgements produced by the eminent researchers in the history of Islam.

Why are Muslims Hanafi, Shafi'i, Maliki & Hanbali? Why do they celebrate the birth of the Beloved Prophet
Salla Allahu ta'ala 'alayhi wa Sallam ? What is the need to use the Prophet Salla Allahu ta'ala 'alayhi wa Sallam as mediation to Allah Subhanahu wa Ta'ala when Allah Subhanahu wa Ta'ala is constantly with us? The pen of Mufti Ahmad Yaar Khan Allah be pleased with him, leaves no stone unturned in answering these and many other objections currently forwarded to the traditional, Sunni Muslims of our age, confirming that Sunni Islam is still the only path founded on the Qur'an & Sunnah and demonstrating why it remains followed by the largest group of Muslims in the world.----Sayyad Muhammad Aleem ud-Din Asdaq Misbahi Aazmi (Founder, Rector & Principal of Darul Uloom Qadria Ghareeb Nawaz, Ladysmith, South Africa).

A Guide to the Conclusive Proofs for the Principles of Belief : (Kitab al-irshad)

Kitab Al-Irshad Ila Qawati Al-Adilla Fi Usul Ati Tiqad        (Great Books of Islamic Civilisation)

By Imam al-Haramayn al-Juwayni                                                                                  Translated by: Paul E Walker

 Paperback - 388 pages

About this book: This work, commonly known simply as a (The Guide) is a major classic of Islamic theology. Its author, Imān al-Haramayn al-Juwayni may Allah be pleased with him (d. 478/1085), was the leading Ash‘arite (Sunni) theologian of his time but he was more famous for his many important treatises on the principles of law and for having been the teacher of the great Imam al-Ghazzāli may Allah be pleased with him. Nevertheless, his writings in the field of theology, especially the present book, represent the high point of its development in the Islamic world until then.

Here the master sets out systematically what he considered the sure proofs for the principles of any discourse about God and His attributes, about what must be said concerning Him, and how the human being should understand what is possible in respect to God.

About the translator:  The translator, Paul E. Walker, gained his Ph.D. in Near Eastern Languages and Civilisations at the University of Chicago and is a historian of ideas at the same university. He specializes in various aspects of Islamic thought in its classical phase (from the ninth to twelfth century) and has written a number of books about individual figures from that period.

The Bequest : al-Wasiyya       by: al-Shaykh Abd al-Mahmud al-Hafyan of Tabat  Paperback - 84 pages                                      Transated by Uthman Sayyid Ahmad Ismail al-Bili

About this book : A great Sufi leader, an accomplished Maliki scholar, a poet and an erudite, spirited writer, the late al-Shaykh Abd al-Mahmud al-Hafyan of Tabat (1919–1973), author of The Bequest (Al-Wasiyya), left a great legacy of scholarly works in all fields of the traditional Islamic sciences. Yet although his contributions to the science of the sharia are outstanding, it is his contributions in the field of haqiqa that most highly rank him amongst the most distinguished of Sufi Muslims.

Sharia for Sufi Muslims is the base of their belief, laws and practice. Haqiqa is the essence, the fundamental truth that leads, through worship, devotion and the love and fear of Allah, to the knowledge and recognition of the Divine, Allah. It paves the way to harmonious living in this world and to eternal bliss in Paradise. Thus to describe Sufism simply as mysticism and Sufis only as mystics is to deny both their base and their legitimacy. The haqiqa of the Sufi Muslim cannot exist without the Qur’an and the Sunna (Prophetic traditions)

This translation of the Wasiyya, The Bequest, is but an approximation of the deep yet elegantly and lucidly stated meanings of the sharia and the haqiqa of Islam. It addresses not only the followers of the Samaniyya Order, or even all Muslims, but all men and women, young and old, who care to listen to the advice of a noble spirit and a great Sufi Muslim, whose influence transcends his time and place.

Paperback vi + 274 pages             A Study of the Juridical Principle of Consensus

Ijma‘ (consensus) is one of the four basic principles of 'fiqh' Islamic Jurisprudence. Besides its legal and cultural manifestations, this doctrine occupies a fundamental position in the development of Islamic thought itself. The author has critically studied the doctrine to provide a deep understanding and clear analysis of a difficult problem.

The first three chapters are introductory studying the social and political role of ijma' and its authority. The following chapters present a detailed analysis of its classical theory, its definition, competence, period, jurisdiction, subject matter and other relevant questions.

The final two chapters deal with its comparative study and with the emrging trends in
ijma.

SHARI'A : Theory, Practice and Transformations

Paperback - 624 pages                                                                                                                 by Wael B.Hallaq

Product Description : In recent years, Islamic law, or Shari'a, has been appropriated as a tool of modernity in the Muslim world and in the West and has become highly politicised in consequence.

Wael Hallaq's magisterial overview of Shari'a sets the record straight by examining the doctrines and practices of Islamic law within the context of its history, and by showing how it functioned within pre-modern Islamic societies as a moral imperative. In so doing, Hallaq takes the reader on an epic journey tracing the history of Islamic law from its beginnings in seventh-century Arabia, through its development and transformation under the Ottomans, and across lands as diverse as India, Africa and South-East Asia, to the present. In a remarkably fluent narrative, the author unravels the complexities of his subject to reveal a love and deep knowledge of the law which will inform, engage and challenge the reader.

Reviews :

'' This masterpiece, to which Wael Hallaq brings the full force of his unparalleled knowledge of the Shari`a … supplies a riveting account of the history of Islamic legal institutions and doctrines, as well as the lived experience of the law. His discussions … mark the coming to full fruition of a new and compelling paradigm in Islamic legal studies. This book promises to be the seminal work in the field for many years to come.'' --- Judith E. Tucker, Professor of History and Director, Academic Programs in Arab Studies, Georgetown University.

'A work of deep learning and great theoretical sophistication, yet highly accessible, this book offers an unrivaled introduction to the Islamic legal tradition. The moral underpinnings of the law have never before been highlighted more clearly or in such varied social and political contexts. Hallaq's portrayal of how the Shari`a has come to be imagined in the modern world and the transformative impact of the nation-state on all facets of Islamic law brings new perspectives to the study of colonial and post-colonial societies, Muslim politics, and modern Islamic thought.' --- Muhammad Qasim Zaman, author of The Ulama in Contemporary Islam.

Sirat ul Ahl us-Sunnah - Exposing the Beliefs of the Deviant Sects

 Paperback - 452 pages                                                                       by Sirat al-Muslimeen

It is important for the Muslims to know about the different sects and their leaders, who have camouflaged under the banner of the 'Ahl as-Sunnah w'al Jama'ah' but are attacking it from within.

Ever since the birth of the Wahhabism sect, Wahhabis, [and now their offspring the Deobandis/Tablighis] have always employed cunning tricks to deceive the Sunnis into adopting the Wahhabi doctrines. One such trick is that Wahhabis claim to be part of the Ahl as Sunnah, claiming to be the rightful heirs of the Salaf. This latter group of Wahhabis call themselves to be "Salafi", calling their movement "Al-Salafiyyah Movement." The reality is that their beliefs afford them relationship neither to the Salaf nor the Ahl as-Sunnah, for they really contradict the Ahl as-Sunnah doctrines (aqaid).

Imam and Hafiz of hadith Abu Ya'la rahmatullahi 'alayh narrates a hadith in his Musnad with the chain going back to the companion of Prophet Salla Allahu 'alayhi wa Sallam, Sayyedina Huzaifa Radi Allahu anhu, that the Prophet of Allah Salla Allahu 'alayhi wa Sallam, said;

"Verily, I fear about a man from you who will read the Qur'an so much that his face will become enlightened and will come to personify Islam. This will continue until Allah subhanahu wa ta'ala wishes when these things will be taken away from him when he will disregard them by putting them all behind him and attack his neighbour with the sword accusing him of Shirk. The Prophet was asked 'Which of the two was commiting Shirk? The attacker or the attacked?' The Prophet replied 'The attacker (the one accusing the other of Shirk)."

The classification of this Hadith is Jayyid.( Strong). Imam Ibn Kathir rahmatullahi 'alayhi, also recorded this hadith in his Tafsir under Surah Al-Araf.

Al-la Madhhabiyya : ABANDONING THE  MADHHABS

Paperback - 180 pages                                                Dr. Muhammad Sa‘id Ramaḍan al-Buti

In the last century, a movement has appeared calling for the abandonment of the traditional Islamic Madhhabs. This misleading call falsely presented as ‘following the Qur’an and Sunnah’ has caused confusion amongst the Muslim masses. The people of knowledge have termed this movement’s call and its supporters ‘la madhhabiyya’.

One of the sources for the spread of this innovation was a book written by Muhammad Sultan al-Ma‘sumi al-Khajnadi al-Makki which was translated and distributed in English as ‘Should a Muslim Follow a Particular Madhhab?’ and ‘The Blind Following of Madhhabs’. It was in response to this book, taught and revered by prominent ‘la madhhabi’ scholars, that Shaykh Dr. Muhammad Sa‘id Ramaḍan al-Buti first wrote his groundbreaking work. Later editions of this book, the translation of which we have before us, included the aftermath of various debates Shaykh al-Buti was subsequently challenged to by his opponents and also incorporated counter-replies to the likes of the late Shaykh Muhammad Nasiruddin al-Albani, Muhammad ‘Id `Abbasi, Mahmud Mahdi al-Istanbuli and Khayruddin Wanli.

This book is a decisive refutation of those who call to the misguidance of ‘Abandoning the Madhhabs’ for it is, indeed,
The Most Dangerous Bid`ah Threatening the Islamic Shari`ah.

Understanding the Four Madhhabs                   by Abdal Hakim Murad

*Booklet - 32 pages                      The Facts about Ijtihad and Taqlid

''The ummah's greatest achievement over the past millennium has undoubtedly been its internal intellectual cohesion. From the fifth century of the Hijra almost to the present day, and despite the outward drama of the clash of dynasties, the Sunni Muslims have maintained an almost unfailing attitude of religious respect and brotherhood among themselves. It is a striking fact that virtually no religious wars, riots or persecutions divided them during this extended period, so difficult in other ways.''

''The ulama of usul recognised as their starting assumption that conflicts between the revealed texts were no more than conflicts of interpretation, and could not reflect inconsistencies in the Lawgiver's message as conveyed by the Beloved Prophet May Allah Bless him and grant him peace. The message of Islam had been perfectly conveyed before his demise; and the function of subsequent scholars was exclusively one of interpretation, not of amendment.''

Islamic Jurisprudence According to the Four Sunni Schools

Paperback - 1003 pages           '' Al-Fiqh ‘ala al-Madhahib al-Arba‘ah ''

by: ‘Abd al-Rahman al-Jaziri

Translator: Nancy Roberts

Introduction: Frank E. Vogel

Islamic Jurisprudence According to the Four Sunni Schools is a translation of Volume I of al-Fiqh ‘ala al-Madhahib al-Arba 'ah, by the Azhari scholar Sheikh ‘Abd al-Rahman al-Jaziri (1882-1941).

Dealing with the forms of worship (ibadat), this work offers an in-depth discussion of ritual purity (taharah), ritual prayers (salat), including funeral prayers and the practice of visiting the tomb of the Prophet Muhammad, May Allah bless him and grant him peace, fasting (siyam), spiritual retreats (i ‘tikaf), charity (zakat), the pilgrimage to Makkah (both al-hajj and al ‘umrah), and the offering of animal sacrifices (qurbani).

Unlike previous works on Islamic law, which offer a medieval perspective, Islamic Jurisprudence According to the Four Sunni Schools is unique in providing the four legal views of ibadat or acts of worship, according to the interpretations of more recent traditionalists trained at al-Azhar University.

It is a valuable and detailed reference work for those interested in Islam, Islamic law or comparative law and contains a glossary of Islamic terminology. This is a must for academic libraries as well as for individuals who want to learn more about the performance of religious duties.

To date this is the only book on the market which brings together the teachings of all four Sunni schools of jurisprudence on a single topic. As such, it provides a unique service by enabling students of Islam, both Muslim and non-Muslim alike, to compare the teachings of the various schools without having to go in search of the relevant source material for each school.  It demonstrates the breadth and mercy of interpretation of each law and provides the Muslim practitioner with various ways in which he or she may fulfill the tenets of the faith.

Review"This is one of the most clear and precise books of contemporary Islamic jurisprudence. It teaches all of the aspects and categories of Islamic jurisprudence according to the four Sunni schools that are followed by the majority of Muslims: The Hanafi, Maliki, Shafi'i & the Hanbali."

Islamic Jurisprudence : by Imran Ahsan Khan Nyazee

Paperback - 426 pages

Islamic Jurisprudence (Usul al-Fiqh)

The discipline of Usul al-Fiqh has received great attention from scholars in every century and rightly so. Today, our expectations from this discipline have increased manifold due to the contact of Muslim societies with other civilizations. The discipline deals with interpretation and legal reasoning. It deals with a large body of rules that guide interpretation. In short, it is not one but many disciplines. Accordingly, this section is divided below into a number sub-disciplines that show that expanse and scope of this field.

This book deals, in a concise way, with fiqh or the substantive law as well as well as with the schools of law along with usul al-fiqh. The first edition of this book was sold out, and work on the second revised edition is nearing completion.

Imran Ahsan Khan Nyazee - Associate Professor in the Faculty of Shariah and Law, Islamabad. He obtained his law degree (L.L.B) from Punjab University in 1969.
