Written in the second Islamic century by al-Imam al-Shafi’i (d. 204AH/820 CE), the founder of one of the four Sunni schools of law, this important work gives the fundamental principles of Islamic jurisprudence and its influence continues to the present day. During the early years of the spread of Islam, the exponents of Islamic legal doctrine were faced with the problems raised by ruling and administering a diverse and rapidly growing empire.

In Madina and Kufa, as well as other cities of early Muslim rule, schools of law had to be developed, but it took the genius of Muhammad b. Idris al-Shafi’i,
May Allah be pleased with him, born in the year 150AH/767CE, to establish the principles by which the various legal doctrines could be synthesised into a coherent system. In the Risala, which laid down the basis for such a synthesis, al-Shafi’i established the overriding authority, next only to the Qur’an, of the Sunna or example of the Prophet Muhammad, May Allah bless him and grant him peace, as transmitted in the traditions. 

Professor Majid Khadduri has done an admirable service in making this valuable work available in English, His excellent translation uses not only the original manuscripts of Ibn Jama’a and al-Rabi, found at Dar al-Kutub, the National Library in Cairo, but also authoritative editions published earlier in this century, namely the Bulaq and Shakir editions. In his introduction, Professor Khadduri outlines the historical background of the Risala and gives a biography of al-Imam al-Shafi’i as well as annotated, detailed summaries of the composition, structure, substance and argument of the text. He also includes a list of transmitters of traditions, a glossary of the most important Islamic legal terms and a select bibliography. For this new edition, the index has been expanded and a small corrigenda added.

A man of great character and learning, he spent forty years under the tutelage of the blessed Imam Abdullah bin Alawi al Haddad May Allah be pleased with him who described him as,‘The learned ascetic who was sent to me’, alluding to his mastery of the Islamic Sciences as well as Tasawwuf.   

Dedicated to the pursuit and promotion of knowledge from an early age, he was known not only for his wisdom and scholarship, but also for the establishment of mosques across the ancient region of Hadramaut. To this day his works remain as a testament to the calibre of his scholarship and rank among the Awliyaa. He died on 19th Sha’bân 1145H, on a Friday.  

 
Sidi Abdal Aziz Ahmed - Translator : Qualified as a teacher from Leicester University in 1984, Abdul Aziz Ahmed was born and raised in Nottingham, UK. He has taught in England, Scotland, USA, Africa and Saudi Arabia. His specialty is Special Needs and Language. His Islamic Studies have taken him to various countries as diverse as Tunisia, Yemen, the Hijaz, Turkey and East Africa. His teachers include the late Shaykh Habib Ahmed Mashur al-Haddad (Jeddah), Shaykh Abdul Rahman al-Kitamy (Kenya), Sidi Fethullah Gulen (Turkey), and Shaykh Ab'ul Qasim ibn Zein Qayrawan (Tunisia). About this book: This work, commonly known simply as a (The Guide) is a major classic of Islamic theology. Its author, Imān al-Haramayn al-Juwayni may Allah be pleased with him (d. 478/1085), was the leading Ash‘arite (Sunni) theologian of his time but he was more famous for his many important treatises on the principles of law and for having been the teacher of the great Imam al-Ghazzāli may Allah be pleased with him. Nevertheless, his writings in the field of theology, especially the present book, represent the high point of its development in the Islamic world until then.

About the translator:  The translator, Paul E. Walker, gained his Ph.D. in Near Eastern Languages and Civilisations at the University of Chicago and is a historian of ideas at the same university. He specializes in various aspects of Islamic thought in its classical phase (from the ninth to twelfth century) and has written a number of books about individual figures from that period.
